 Rhode Island State Police/HIDTA Task Force Arrests Four Subjects on Marijuana Distribution Charges

Rhode Island – Colonel Steven G. O’Donnell, Superintendent, of the Rhode Island State Police and Commissioner of Public Safety, announces the arrest of four subjects on marijuana distribution charges by the High Intensity Drug Trafficking Area (HIDTA) Task Force.

In November 2015, a complaint was received regarding individuals at the Elevated Lounge, located at 15 Peck Street in Providence. These individuals, who were associated with Rhode Island Care and Patients Services (RICAPS), were acting as an unlicensed compassion center and were allegedly providing marijuana to medical marijuana patient card holders, as well as people who did not have cards. HIDTA initiated an investigation and as a result, undercover officers were able to purchase marijuana from four individuals at the Elevated Lounge. These four individuals were identified and a search warrant for the Elevated Lounge and four arrest warrants were obtained.

On January 12, 2016 at 5:00 p.m., members of the HIDTA Task Force, with the assistance of Providence Police, executed a search warrant at the Elevated Lounge at 15 Peck Street in Providence. This search warrant resulted in the seizure of 21 bottles of liquid tincture THC, 93 bottles of cannabis syrup, 100 marijuana edible candies, 65 grams of marijuana and $2,426.00 in United States currency.

As a result of this investigation, the following individuals were arrested:

Douglas Mulcahey, age: 25, of 42 Cherry Street, Warwick, Rhode Island, is alleged to have been in possession of the 21 bottles of liquid tincture THC, 93 bottles of cannabis syrup, 100 marijuana edible candies, 65 grams of marijuana. He was arrested and charged with:

– Five (5) counts of Delivery of Marijuana to a Police Officer
– Two (2) counts of Controlled Substance Conspiracy
– Possession with Intent to Deliver Marijuana

Alexis Byrd, age 23, of 42 Cherry Street, Warwick, Rhode Island, is alleged to have been in possession of the 21 bottles of liquid tincture THC, 93 bottles of cannabis syrup, 100 marijuana edible candies, 65 grams of marijuana. She was arrested and charged with:

– Two (2) counts of Controlled Substance Conspiracy
– Possession with Intent to Deliver Marijuana

Frank Pellegrino, age 24, of 173 Pleasant Street, Cranston, Rhode Island, was arrested and charged with:

– One (1) count of Delivery of Marijuana to a Police Officer
– One (1) count of Controlled Substance Conspiracy

Kevin Holmes, age 24, of 144 Hendricks Street, Providence, Rhode Island, was arrested and charged with:

– One (1) count of Delivery of Marijuana to a Police Officer
– One (1) count of Controlled Substance Conspiracy

All four subjects were held overnight at State Police Headquarters and will be presented at 6th Division District Court, One Dorrance Plaza, Providence, Rhode Island for arraignment.

Every person violating the provisions of Delivery or Possession with Intent to Deliver Marijuana, upon conviction, may be imprisoned for not more than thirty (30) years, or fined not more than one hundred thousand dollars ($100,000) nor less than three thousand dollars ($3,000), or both.

The HIDTA Task Force is managed by the Rhode Island State Police and comprised of members from Providence Police, Pawtucket Police, Johnston Police, Central Falls Police, North Providence Police, West Warwick Police, United States Bureau of Alcohol, Tobacco and Firearms (ATF), United States Drug Enforcement Administration (DEA), and the United States Bureau of Immigration and Customs Enforcement-Homeland Security Investigations (HSI).
